11. Customer responsibilities
- Provide high-resolution artwork (vector format recommended: AI, EPS, SVG, PDF).
- Hold the intellectual and industrial property rights to the submitted designs, indemnifying Xtampa against any third-party claims.
- Thoroughly review the digital proof before approval; approval binds the result.
- Check the goods on receipt and report any issues as soon as possible. The 48-hour period used to facilitate logistics does not limit statutory consumer rights or the rights of professional customers.
- Provide accurate and up-to-date tax and contact details.
12. Warranties
12.1. Legal warranty (B2C consumers)
Consumers benefit from the legal guarantee of conformity of 3 years from delivery of the goods (art. 120 TRLGDCU, following the reform by RD-Law 7/2021). For customised products, the warranty covers manufacturing or printing defects, not the variations inherent to promotional textiles indicated in section 2.
12.2. Commercial warranty (B2B)
For professional customers, Xtampa guarantees the conformity of the work with the approved proof. Claims for visible defects must be reported within 48 hours of receipt; hidden defects within a reasonable period from their discovery (arts. 342 et seq. of the Commercial Code).
12.3. Remedy
In the event of a proven defect, Xtampa will offer repair or replacement of the product. If this is not possible, a proportional refund of the affected amount will be made.
13. Force majeure
Neither party shall be liable for failure or delay caused by force majeure or fortuitous event (art. 1105 Civil Code), including but not limited to: natural disasters, pandemics, transport strikes, logistics blockades, widespread power or telecommunications failures, or unforeseen stock unavailability on the part of suppliers. In such cases, deadlines shall be suspended for the duration of the impediment and Xtampa will inform the customer as soon as possible.
14. Limitation of liability
Xtampa's total liability for any claim arising from an order shall not exceed the net amount invoiced for that order. Xtampa shall not be liable for indirect damages, loss of profit or damages arising from the use or inability to use the products, except in cases of wilful misconduct or gross negligence. This limitation does not affect the mandatory rights of consumers (B2C).
